Security in swimming-pools

The decree for enforcing the law of January 3, 2003 on security in swimming-pools provides that the owners of private swimming-pools, for either individual or joint use (i.e. family or resident-reserved swimming-pools, swimming-pools in holiday clubs and centres, hotels, self-catering cottages, camping, etc), open air swimming-pools with buried or semi-buried pool, install a security device in accordance with AFNOR NF P90-306, NF P90-307, NF P90-308 and NF P90-309 standards.

Reminder of the law n° 2003-9 of January 3, 2003

All swimming-pools built before January 1, 2004 should be equipped with one of the four protection devices mentioned below (AFNOR standard) before January 1, 2006. Be careful, for the rented houses, this obligation shall be enforced before May 1, 2004. In the case of a swimming-pool built after January 1, 2004 or the building of which ends after this day, either the engineer or the builder has to provide the client with a technical sheet indicating the standardized security device.

The four standardized security devices are as follows:
› Protection barriers and access means to the pool (NF P90-306)
› Alarm systems (NF P90-307)
› Security covers and hanging devices (NF P90-308)
› Swimming-pool shelters (light structures and/or verandas) (NF P90-309)

Failure to observe the provisions of articles L. 128-1 and L. 128-2 on the swimming-pool security is punished with a EUR 45,000 fine. Legal entities may be hel d criminally liable , on the basis of the provisions of article 121-2 criminal code, for violations set under the articles L. 128-1 and L. 128-2
